Creative nature of a journalistic work protected by law - legal premises of the protection

According to art. 1 Polish copyright law the scope of copyright encompasses any manifestation of creative activity of an individual nature, no matter in what form it comes into being and regardless of its value, purpose or manner of its expression (the work). The simple press reports are not the subject of copyright but this type of writing is not the only one and most of the journalistic editorials have the signs of creative activity and should be protected by law. Press work is a part of a periodical publication which is the subject of copyright without the prejudice to the rights contained in them. Economic rights in a joint work (periodical publication) lie with the publisher, while the copyright in individual and autonomous parts of the whole lies with their creators. Works expressed in words are included among works which are the subject of copyright but for the press work to undergo law protection it has to contain several necessary features such as: creative nature, individual non repetetive character, established anyhow, even in an incomplete form.
